NeoMonitor End User License Agreement

This agreement is between you and Dmytro Yevdokymenko (Євдокименко Дмитро Вікторович), a sole proprietor (ФОП) registered in Ukraine, Tarasivka, Kyiv region, email support@neomonitor.dev ("we", "us"). It covers the NeoMonitor software, its updates and its documentation ("the Software"). By installing or using the Software you accept this agreement. If you do not accept it, do not install the Software.

1. Editions

• Free. You may use the free edition at no charge, for personal and commercial purposes, on any number of computers.
• Pro trial. The first 14 days after the first start unlock Pro features at no charge. After that the Software returns to the Free edition unless you enter a license key.
• Pro. A Pro license key unlocks Pro features. A key is for one person and may be activated on up to 3 computers that this person uses. To move a key to another of your computers, ask us at support@neomonitor.dev and we free a place.

2. Pro subscription and updates

• A monthly or yearly Pro license gives you Pro features and all updates for the paid month or year, at no extra cost.
• When the paid period ends and you do not renew, the Software switches to Free. Free keeps working and keeps receiving updates; Pro features come back when you renew.
• A lifetime Pro license (if offered) gives you all future versions for as long as we publish the Software.
• Payment, renewal and cancellation are handled by our reseller Paddle (see section 9 and the Terms of Sale).

3. What you may not do

• Share, sell, rent or publish license keys, or let more people use one key than section 1 allows.
• Remove or bypass license checks, or distribute modified copies of the Software.
• Reverse engineer the Software, except where the law allows it despite this restriction.
• Use the Software to break the law or the rules of a game or service you use.

4. Third-party components

The Software includes third-party components, such as LibreHardwareMonitor (MPL-2.0), the PawnIO driver (GPL-2.0-or-later) and its modules (LGPL-2.1-or-later). Each is licensed under its own license, listed in licenses\THIRD-PARTY-NOTICES.txt. Nothing in this agreement limits the rights those licenses give you for those components. Source code for the MPL, GPL and LGPL components is available as stated in that file and on our download page.

5. Stress tests and hardware

The Software can put your processor, graphics card, memory, storage and network under full load for extended periods (stress tests, benchmarks, GAME CHECK). This raises temperatures and power draw. Run these tests only on hardware that is cooled and maintained properly. You run tests at your own risk. The Software reads sensors through a kernel driver; sensor readings may be inaccurate on some hardware. Do not rely on the Software as the only protection against overheating.

6. Data and privacy

The Software works offline. It contacts our servers only to check for updates, to activate and verify a Pro key, and, if you choose, to send a bug report or anonymous hardware statistics. Details are in our Privacy Policy at https://neomonitor.dev/privacy.

7. No warranty

The Software is provided "as is". To the extent the law allows, we give no warranty that it is free of errors, fits a particular purpose, or works with every computer, game or anti-cheat system. Mandatory consumer rights under the law of your country are not affected.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential damage, lost data, lost profit, or damage to hardware arising from use of the Software. Our total liability is limited to the amount you paid for the Software in the 12 months before the claim. This does not limit liability for intent, gross negligence, or death and personal injury, or any liability that cannot be limited by law.

9. Purchases and refunds

Paddle.com Market Ltd is the reseller and merchant of record for Pro purchases; their buyer terms apply to the payment. You may ask for a full refund within 14 days of purchase without giving a reason (see the Refund Policy). A refunded key is deactivated.

10. Termination

This license ends automatically if you break it. On termination you must stop using the Pro features and delete copies obtained in breach. Sections 4, 7, 8 and 11 survive.

11. Law and disputes

Ukrainian law applies. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a claim in its courts. Please contact support@neomonitor.dev first; we answer within 3 working days.

12. Changes

We may update this agreement for new versions. The version shown in the installer of the version you install applies to that version.

13. Microsoft components

The Software includes Microsoft runtime components (Visual C++ runtime, Windows components used by Python). Microsoft and its suppliers give no warranty for them to you and are not liable for them. You may not separate these components from the Software.
